Data Controller

A data controller decides why and how personal information is processed. For school-directed assessments, the school normally acts as controller and SudoStudy acts as its processor. GitCode Limited acts as controller for its own account administration, billing, security and other purposes described in our Privacy Policy.

GitCode Limited is a company registered in Hong Kong (Company No. 2989521). Before using any of our services, please carefully read our Terms of Service. You shouldn't use our services if you disagree with our Terms of Service. Additionally, you should read the SudoStudy Privacy Policy, which explains how personal information is handled. Accepting these terms does not replace consent where consent is required by law.

Terms of Service/Use

What is SudoStudy

SudoStudy is a secure, service-based platform that allows teachers and students to create customized quizzes acquiring multiple choice questions from across different GCSE and A-level boards, and it allows students an easy-to-use way of taking those quizzes.

Who do these terms apply to?

These terms apply to individual account holders and schools using SudoStudy. A school must have authority to provide student information and give appropriate privacy information to its users. School-directed processing is governed by the school's agreement with us, including the applicable data-processing terms. A student does not become a data controller simply by using an account. Our roles for different processing activities are explained in the Privacy Policy.

Restrictions and Responsibilities

Usage

With the aid of SudoStudy, teachers may assist students to embed knowledge in their long-term memory and for students in developing their recall. You consent to using Our services solely for this reason.

Data Ownership

You will continue to be in charge of your data when you choose to utilize SudoStudy. We handle the data in the manner that you've asked on your behalf. You are always in charge of your data, including any mistakes or modifications that need to be made, and you are also in charge of ensuring that processing is always lawful and appropriate. All of Your school's data on the platform is also under Your control as the data controller.

Account Security

If you choose to use SudoStudy, you are in charge of keeping your account secure and are solely accountable for any acts related to it. It is Your duty to make sure that Your account is safe and that access is limited only to those with the relevant authorization. The platform is for the exclusive use of those who have the required authority to access this data. If there is any unauthorized access to Your account or any other security breaches, you must contact Us right away.

Modification of Services

As a company that constantly keeps growing and getting better, it could occasionally be essential to change Our services. At our sole discretion, we may on occasion suspend, remove, or make certain tools or services premium (and thus part of a paid-for Subscription), or we may make certain tools or services that were previously premium (and therefore part of a paid-for Subscription) free. Where possible, we will notify you of any changes before they are put into effect or as soon as possible after. However, we retain the right to change prices, availability, or both with respect to any specific tools or services for any reason and without prior notice.

Subscriptions

The services offered by SudoStudy are both free and paid-for services. Depending on the type of Subscription plan that We provide and that You choose when purchasing the Subscription, You will be invoiced on a recurring and periodic basis (monthly, yearly, or based on a customized subscription) when you choose a paid-for Service.

Unless You cancel it or We cancel it, Your Subscription will automatically renew at the end of each period under the same terms.

It is also important to note that, except as provided in the "Refund Section" of these conditions, Subscriptions are non-refundable.

Refunds

Paid Subscription Fees are non-refundable unless otherwise stated or as required by law.

We reserve the right to assess individual refund requests for Subscriptions and to decide whether or not to comply.

Disclaimer

You acknowledge that tools are offered "as is" and "as available." They come with no assurances or warranties. We accept no responsibility for and do not guarantee, the accuracy, integrity or quality of any content or Question Banks (including the question bank exclusively introduced by the SudoStudy website). Neither does SudoStudy guarantee that the website or any of the tools will operate without errors or that access will be continuous and uninterrupted.

Liability

We will not, under any circumstances, be accountable to You or anyone else using the SudoStudy website at your invitation for any loss of profits, business, sales, or revenue (direct or indirect); business interruption; loss of predicted savings; corruption or loss of data or information; loss of business opportunity, goodwill or reputation; or any other claim arising under or in connection with this agreement. We are not eliminating liability for accidental death or bodily damage, violation of an implicit warranty, or any other situation in which doing so would be against the law.

Termination

If We have reason to believe that You may have violated the terms of this agreement, We reserve the right to stop or restrict Your access to Our services. We retain the right to immediately suspend or terminate Your access to the SudoStudy platform if You violate any provision of this Agreement.

Changes to Terms of Service

Our services are always being updated and improved. As a result, we occasionally need to expand upon or change the conditions under which we provide our services. Wherever possible, we will attempt to give you the necessary notice of any major modifications we make to these Terms or any additional or new Terms. You must stop using our service if you don't agree with the changes. Any use of our services after a change to the terms becomes effective implies acceptance of the changed terms, and any such use is subject to the changed terms.
